Entrusted Legacy Law Founding Attorney, in Warrendale, PA., elaborated how a Will and a Revocable Living Trust can make situations easier when a person passes away or becomes incapacitated.
Disasters such as car accidents can leave people incapacitated and unable for them to make independent decision-making. That means family and loved ones have to step in and help.
But that scenario would be much more advanced and much easier to deal with if the likes of an estate plan included a healthcare directive for medical decisions, as well as giving financial and legal power of attorney to a spouse, for example, to help ease decision-making on behalf of their incapacitated partner.
She said: "The first point is to consult an estate planning attorney to discuss different options. A Will should specify who is named as the executor of the estate and carry out a person's wishes, determine who will care for any young children, and outline how property and assets will be distributed.’’
"Furthermore, health and financial directives in the estate plan can give direction to loved ones when a person falls ill and clarifies in times of difficulty."
She recommended listing an alternate person as both an executor of the Will and agent under the Powers of Attorney and healthcare directive if the first choice, usually a spouse or child, cannot fulfill the role.
Sharek advised: "Dying without making a Will can cause unnecessary grief for family and may provoke fights in areas where there is doubt over the estate.’’
"A probate court may have to intervene if a person dies intestate and make decisions on allocating assets in a way that person never intended. While we can't control every aspect of our lives, we can control what happens to our assets through the probate process. For those who want to avoid probate entirely, a Revocable Living Trust is the best option."
She emphasized: "Estate planning will help avoid any room for argument. It can help save you and your family from needless additional expenses, future headaches and heartaches if something untoward happens.”
