That settlement removed mandatory buyer-agent commission fields from MLS listings, moving buyer-agent compensation into private negotiation between sellers and buyers, often as a seller concession. Under the lower-tier packages, sellers generally handle pricing, photography, showings, buyer communications, and offer evaluation themselves, while Congress Realty manages the technical work of entering and maintaining the MLS listing. The company frames this division of labor as a trade-off, since sellers who are organized and comfortable managing their own transaction can realize savings that a full-service model would not offer.
New Mexico law adds a specific disclosure step to this process: before accepting any offer, a seller must request an estimated property-tax levy from the county assessor using the listing price and provide that estimate to the prospective buyer. Congress Realty's packages are designed to support this compliance step while leaving the legal responsibility for disclosures with the seller, consistent with the state's Real Estate Disclosure Act.
